§ 30.01.001. Naming of unnamed existing public and private streets and roads.

  • A.

    The naming of unnamed existing public and private streets and roads in the County outside of municipalities shall be effected by resolution of the County Council, provided that no less than seven (7) days prior to final action of the County Council the Department of Land Use shall cause at least one (1) public notice thereof to be posted along the street or road concerned, and the Clerk of the County Council shall cause such notice to be published at least once in a newspaper of general circulation in the County.

    B.

    The term "existing public and private streets and roads," as used in this Section, shall mean those public and private streets and roads which exist in fact or which exist as a result of being shown on either a record plan or a plan proven to be an existing plan as defined in Chapter 40 of this Code pertaining to subdivision and land development.

    C.

    A copy of all such resolutions adopted by the County Council shall be recorded by the Clerk of the County Council in the Office of the Recorder of Deeds in and for the County and indexed alphabetically by name. A copy of all such resolutions adopted by the County Council also shall be forwarded to the State Highway Department and to the Department of Elections for the County and to the post office in the City of Wilmington and at the post office nearest the street or road concerned.
